Terms of Service

Welcome to Romancier. These Terms of Service (“Terms”) govern your use of the Romancier mobile application and website at romancier.app (“Service”), operated by Romancier (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Romancier app, you confirm that you are at least 18 years of age and agree to these Terms. If you do not agree, you may not use the Service.

2. Description of Service

Romancier is a relationship enrichment application designed to help couples strengthen their connection through guided activities, daily check-ins, reflections, and curated content. The Service may include:

• Daily relationship activities and prompts
• Mood and engagement tracking
• Personalized content and recommendations
• Community features and shared experiences
• Integration with the Neuro-Relational Program (NRP) for enrolled couples

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscriptions and Payments

Free and Paid Tiers

Romancier offers both free (Spark) and paid (Plus) subscription tiers. Paid subscriptions provide access to additional features and content.

Billing

• Paid subscriptions are billed on a recurring basis (monthly or as specified at the time of purchase)
• Payment is processed through the applicable app store (Apple App Store or Google Play) or through our website payment processor
• Prices are subject to change with reasonable notice

Cancellation

• You may cancel your subscription at any time through your app store account settings or by contacting us
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods unless required by applicable law

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Share content that is abusive, harassing, threatening, or harmful
• Impersonate another person or misrepresent your identity
• Attempt to access another user’s account without authorization
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated means (bots, scrapers) to access the Service
• Upload malware or any harmful code
• Use the Service to spam or send unsolicited communications

6. User Content

• You retain ownership of content you create within the app (journal entries, reflections, check-ins)
• By using the Service, you grant us a limited license to store, process, and display your content as necessary to operate the Service
• We do not claim ownership of your personal content
• We may remove content that violates these Terms or applicable law

7. Intellectual Property

The Romancier app, including its design, content, features, graphics, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

8. Not a Substitute for Professional Help

Important: Romancier is a relationship enrichment tool, not a substitute for professional counseling, therapy, or medical advice. The content and activities provided through the app are educational and supportive in nature.

• If you are experiencing a mental health crisis, domestic violence, or any emergency, please contact emergency services or a qualified professional immediately
• The NRP integration feature facilitates connection with licensed clinicians but the app itself does not provide clinical services
• We make no guarantees about specific relationship outcomes from using the Service

9. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

• You may terminate your account at any time by contacting us or through the app settings
• We may suspend or terminate your access if you violate these Terms
• Upon termination, your right to use the Service ceases immediately
• You may request deletion of your data upon termination, subject to legal retention requirements

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the app or via email. Your continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you should discontinue use of the Service.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Alabama.
